TERMS and CONDITIONS

ELIGIBILITY: The Wellness Week is open to Port of Los Angeles (“POLA”) staff only. POLA staff is defined as employees, student workers, consultants, and contractors. Staff of POLA and its affiliates, parents or subsidiaries, respective parent, subsidiary, and affiliate companies and advertising and promotion agencies, persons engaged in the development of Program materials or events, and members of their immediate families (spouses, parents, children, and siblings and their spouses) living in the same household of each are not eligible. Groups, clubs, organizations, commercial entities and businesses cannot participate. Void where prohibited by law and subject to all federal, state and local laws.   

PROGRAM PERIOD: The Wellness Week begins 9:00 AM Pacific Time (“PT”) on October 21, 2024 and ends 8:00 PM PT on October 25, 2024. Final Announcement of winners will be on October 30, 2024 via email.    

HOW TO PARTICIPATE: During the Program Period, participate in as many Health and Wellness activities. Scan the code on the back of the Rewards Passport to be directed to www.POLAWellness2024.org (“the Site”) for list of schedule and signup opportunities. The available reward items are outlined on the Site. At the end of the Program, the Rewards Passport will be submitted to any of the following office/box for final calculation.  

WAYS TO EARN PRIZES:

RAFFLE TICKETS: Raffle tickets can be obtained in two ways:  

  • Blue Raffle Tickets were provided through the Wellness Packet sent to all employees. 

  • Other Raffle Tickets can be earned after participating in in-person event Activities during the Health Fair. An event facilitator will distribute tickets at the end of each activity for a chance to win a prize while supplies last. 

Write your full name, division, and phone number on the raffle tickets, which will be entered into a drawing for prizes. Submit raffle tickets any time during the Program Period at any in-person Event Activity, at designated locations during the Health Fair, or at the locations identified below:  

  • C&M Administration Building Lobby 

  • Port Police Headquarters Lobby   

  • HAB Lobby   

REWARDS PASSPORT: During the Program Period, earn points by participating in event activities

  • In-person Activities: Attendance for at least 75%  or more during the respective in-person activity is required to receive credit. Present your Rewards Passport and an onsite event staff personnel will stamp your Rewards Passport as proof of attendance for points.  

  • Virtual Sessions: Attendance for 100% of a virtual event is required to receive credit. A code will be provided in the virtual session for you to write into the designated event slot on your Rewards Passport.  

Write your full name, division, and phone number on the front of the Rewards Passport, which will be entered into a drawing for prizes. For final tally, please tally your total points at the bottom of the front cover where it lists “TOTAL PTS”. Anytime during or at the end of the Program Period, and in order to be eligible to participate in the drawing for prizes, participants must submit the hard copy of the Rewards Passport to any of the following locations for final calculation.   

  • C&M Administration Building Lobby 

  • Port Police Headquarters Lobby   

  • HAB Lobby 

POINTS TRACKER  

Points are given per each In-Person Activity or Virtual Session attended as described above.   

  • Lunch Time Fitness (Gym Days and Walking Days) = 3 points per session / max 12 points   

  • Virtual Session(s) = 2 points per session / max 30 points 

  • Health Fair Workshop(s) (e.g. Stretching Session) = 3 points per session / max 12 points 

  • Health Fair Primary Care Screening(s) (e.g. Spinal Assessment) = 5 points per visit / max 15 points 

  • Health Fair Wellness Service(s) (e.g. Flu Shot) = 2 points per one time visit / max 8 points 

  • Other = 3 points per one time visit / max 6 points 

TOTAL MAX POINTS POSSIBLE: 83  

Any points remaining in a participants’ account at the end of the Program Period will be forfeited without compensation. Points have no cash value and are only redeemable for rewards offered in the Rewards Program. Each participant is responsible for ensuring the accuracy of his/her account and is encouraged to check his/her account regularly.   

PRIZES: Prizes are divided into different levels. Limit one prize per POLA employee, as defined in the Eligibility section above.  

  • Prize level 1 is available to employees, student workers, consultants, and contractors.  

  • Prize levels 2-3 are available to employees only.  

Prizes must be collected within the time specified or will be forfeited.     

Refunds, exchanges and other issues are governed by the vendors terms and conditions applicable to the purchase and are not the responsibility of Sponsor. Sponsor reserves the right to modify the available items for redemption and corresponding point totals at any time during the program. Participants must redeem points prior to the end of the Program Period, unless extended or otherwise modified by Sponsor. Any points remaining in a participants’ account at the end of the Program Period will be forfeited without compensation. Points have no cash value and are only redeemable for rewards offered in the Rewards Program. Each participant is responsible for ensuring the accuracy of his/her account and is encouraged to check his/her account regularly.

GENERAL RULES: Participants may not combine, transfer, sell, or dispose of codes in violation of these Terms and Conditions. Any attempt to do so will result in disqualification from the Rewards Program and forfeiture of points. Sponsor reserves the right to take further action if it believes a participant has violated these rules. Points earned will be subject to verification, and codes obtained through illegitimate means or tampered with are void. Sponsor may modify the Terms and Conditions, Program Period, or point redemption process at any time, with or without notice, even if these changes affect the participant's ability to accrue or redeem points. By participating, participants agree to be bound by these Terms and Conditions. Sponsor is not responsible for technical issues, system malfunctions, or network failures that affect participation. Participants found tampering with the Rewards Program or attempting to gain points by fraudulent means will be disqualified. Sponsor may cancel the program in the event of technical failures or other causes beyond its control. By participating, participants release Sponsor and its affiliates from any liability arising from participation in the Rewards Program or use of any rewards. Participants agree to indemnify and hold the Sponsor harmless against any third-party claims or damages arising from a breach of these Terms and Conditions. 

NO PURCHASE NECESSARY: No purchase or payment is necessary to participate in or win this raffle. Participation is free, and entries can only be obtained by completing the designated activities during the Program Period. A purchase will not increase your chances of winning.   

PRIZES PROVIDED "AS IS": Prizes are awarded 'as is' without any warranties or guarantees, either express or implied, except as may be offered by the manufacturer or supplier of the prize. The Sponsor is not responsible for any issues or defects with the prizes once delivered to the winner.  

PRIZE TRANSFERABILITY: Prizes are non-transferable and must be accepted as awarded. No substitution, cash redemption, or transfer of prizes is permitted except at the Sponsor's sole discretion. Sponsor reserves the right to substitute a prize of equal or greater value if the advertised prize becomes unavailable for any reason.  

PRIZE LIABILITY: All prizes offered in the Rewards Program are awarded "as is" and without warranty of any kind, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). Port of Los Angeles (POLA) does not make any representation or warranty with respect to the safety, appearance, or performance of any prize offered.   

Upon transfer of a prize to a winner, POLA and its affiliates, parents, subsidiaries, advertising and promotion agencies, and all their respective officers, directors, employees, representatives and agents will have no further responsibility or liability with respect to the prize. This includes, but is not limited to, any injuries, damages, or losses of any kind sustained by the winner or any third party as a result of the use or misuse of the prize.   

Winners assume all risk and liability for any injury, loss, or damage of any kind arising from or in connection with the prize or use of the prize, including, without limitation, any injury, loss, or damage to person or property. This applies whether the injury, loss, or damage is caused by the negligence of POLA or otherwise, and whether the injury, loss, or damage occurs during the use of the prize or as a result of acceptance, possession, or use or misuse of the prize.   

The winner is solely responsible for any taxes, fees, and costs associated with prize receipt and/or use. By accepting a prize, winners agree to release and hold harmless POLA and its affiliates from and against any claim or cause of action arising out of participation in the Rewards Program or receipt or use of the prize, including, but not limited to: (a) unauthorized human intervention in the Rewards Program; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Rewards Program or the processing of entries; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Rewards Program or receipt, acceptance, possession, use or misuse of any prize.   

Winners acknowledge that POLA has neither made nor is in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition, or fitness for a particular purpose.   

DISPUTES: All disputes related to this Rewards Program will be resolved individually by the Port of Los Angeles Risk Management Team. No class actions permitted. Participant's recovery is limited to actual out-of-pocket costs incurred in program participation. No attorney's fees will be awarded. Participant waives rights to indirect, punitive, incidental, or consequential damages. No multiplied or increased damages allowed. These Terms and Conditions, and all related rights and obligations, are governed by California State law, regardless of conflict of law principles. Venue for any legal action will be in Los Angeles County, California.   

FORCE MAJEURE (CANCELLATION OR POSTPONEMENT CLAUSE): In the event that the Program is delayed, canceled, or postponed due to circumstances beyond the Sponsor's control, including but not limited to acts of God, war, terrorism, government action, natural disasters, pandemic, or any other events or circumstances that make the continuation of the Program impracticable or impossible, Sponsor reserves the right to modify, suspend, or cancel the Program without prior notice or liability. 

PRIVACY: Any personal information that you provide in connection with the Rewards Program shall be kept private and used solely for the purpose of this event. 

DATA PRIVACY (NO SHARING OR SELLING OF PERSONAL DATA & CCPA COMPLIANCE): Any personal information collected in connection with the Program will be used solely for the purpose of administering the raffle and communicating with participants. Sponsor will not sell, share, or otherwise disclose personal information to third parties, except as required by law. If you are a resident of California, we comply with the California Consumer Privacy Act (CCPA), which grants you certain rights regarding your personal information. You have the right to request access to, deletion of, or knowledge of what personal data we collect about you, and how we use it. Sponsor will not sell your personal information under any circumstances.
